Policy On Disclosure Of Relevant Affiliations

The following policy on disclosure of relevant financial affiliations shall apply to all regular on-air contributors, in-studio guest contributors, and in the field interviewees of energyNOW! (“EN!”):

1. Regular On-Air Contributors And In-Studio Guests. All regular on-air contributors and in-studio guest contributors shall disclose to the EN! Senior Executive Producer (“SEP”) any financial affiliations which a reasonable EN! viewer would perceive as relevant in evaluating information imparted by the contributor (“Relevant Affiliations”). If the EN! SEP learns of any Relevant Affiliation which he believes should be disclosed to EN! viewers, the EN! SEP shall make arrangements to have such affiliation(s) disclosed. Relevant Affiliations include but are not necessarily limited to: (a) the identity of a contributor’s employer, at the time that contributor tapes an EN! broadcast; (b) any consulting or client arrangement involving an energy company or organization (or other entity which is the subject of an EN! interview or segment) for which contributor receives remuneration within the twelve (12) months prior to the time that contributor tapes an EN! broadcast; (c) any service on a board of directors of an energy related company or organization at the time that contributor appears on an EN! broadcast; and (d) any Contributor financial interest in an energy-related company that is greater than $100,000 at the time that Contributor tapes an EN! broadcast.

2. Field Interviews. To the extent practicable, any EN! employee or contractor conducting a field interview shall, prior to filming, ask all persons to be interviewed to disclose any Relevant Affiliations. If the EN! employee or contractor conducting a field interview learns of any Relevant Affiliation of the interviewee which the interviewer believes should be disclosed to EN! viewers, the interviewer shall, prior to filming, secure the permission of the interviewee that such affiliation(s) may be disclosed and make arrangements with the EN! SEP or other production staff to have such affiliation(s) disclosed.

3. Method of Disclosing Relevant Affiliations. The EN! SEP or other production staff retain discretion to determine whether a contributor or interviewee affiliation shall be disclosed on-air or via the EN! website; however, there shall be a preference for on-air disclosure prior to, or immediately after the contributor or interviewee imparts information to the EN! viewing public.

4. Contributor Questions Regarding Relevant Affiliations. Any contributor questions regarding Relevant Affiliations or disclosures should be directed to the SEP, who may seek advice from the Ombudsman and/or legal counsel.

5. Confidentiality Of Potentially Relevant Affiliations Not Deemed To Be Disclosable. No EN! employee or agent who receives information from a contributor about a Relevant Affiliation shall publically disclose to a third party or use such information other than to determine whether a Relevant Affiliation should be disclosed pursuant to Paragraph 3 of this Policy. A violation of this Paragraph may be grounds for termination from employment or affiliation with EN!.

6. Maintenance of Disclosure Files. The SEP shall assign an assistant who is an EN! employee to regularly review and keep current all disclosures. All information must be properly secured and marked confidential.
